Switching agents
How do you change your domestic agent in Korea?
You appoint the new agent in writing, end the old contract, and update every place the law asks you to publish the agent — usually your privacy policy, your terms of service or your website. Set the new start date to the day the old agent stops and there is no gap in coverage.
What do you need to check first?
- The notice period and end date in your current agent contract
- Which Korean laws your current agent covers, and which it does not
- Where the agent is published today: privacy policy, terms of service, website, store front page
- Whether you have a Korean entity — under some laws that entity must be the agent
- Any regulator request or user complaint that is still open
What changes under each law?
| Law | Update | Filing |
|---|---|---|
| PIPA | Privacy policy | None required by the statute |
| Network Act | Website or similar channel | None required by the statute |
| Game Industry Promotion Act | Terms of service | None required by the statute |
| AI Basic Act | No disclosure rule | The appointment is filed with the Ministry of Science and ICT |
| Telecommunications Business Act | No disclosure rule | None required by the statute |
| E-Commerce Act (from 21 Jan 2027) | Front page of the online store | Agent details sent to the FTC without delay after a change |
How does a switch to KoreaAgent run?
- Review. We read your current contract, notice period and published wording.
- Designate. You sign with us. Our start date is the day your current agent stops.
- Hand over. We draft the termination notice for you to send and ask the current agent for open matters.
- Update. You get replacement wording for each page, and any filing the law requires is prepared for you.
- Confirm. We tell you when the first inquiry through the new contact details has been handled.
Questions
Do we need the regulator’s approval to change our domestic agent?
PIPA, the Network Act and the Game Industry Promotion Act do not require you to file the appointment, so there is no approval step under those laws. What changes is the public record: the agent details in your privacy policy, website or terms of service.
Is there a fee to switch to KoreaAgent?
No. We prepare the documents and the replacement wording at no charge.
What if a regulator request is open when we switch?
We ask your current agent to hand over open matters, log each one as a case on our side, and track its deadline from the day we start.
We have a Korean subsidiary. Can we switch to an outside agent?
Under PIPA and the Telecommunications Business Act, and under the E-Commerce Act from January 2027, a Korean entity you set up or control must be the agent. In that case your entity stays the agent and we can run the work behind it.
